Terms of Service

Please read these terms carefully before using our services.

These Terms of Service (the “Agreement”) govern the use of www.receive-sms-online.info and the services made available through it. The Agreement is between the legal entity identified in the Operator Details below (the “Operator”) and the person or entity using or purchasing the Services (the “User”). If a person acts on behalf of an entity, that person confirms that he or she has authority to bind that entity.

By using the Website, ordering a paid Service or otherwise accessing the Services, the User agrees to this Agreement and to the Operator’s applicable Privacy Policy and other policies made available on the Website.

The Operator may update these Terms where reasonably necessary, including because of changes to the Services, applicable law, regulatory requirements, security requirements or operational requirements. Material changes affecting an existing paid Service will be communicated where reasonably practicable. Changes to pricing will not apply retrospectively to a Service already purchased.

3. Rights and Obligations of the Parties

3.1. The Operator may:

  • 3.1.1. Suspend, restrict or modify a Service where reasonably necessary because of technical problems, maintenance, security concerns, third-party network restrictions or other operational reasons.
  • 3.1.2. Suspend or terminate access where the User materially breaches this Agreement, uses the Services unlawfully, creates security or fraud risks, interferes with the Website or Services, or causes unreasonable load or disruption.
  • 3.1.3. Update the Website, Services, Rates and policies in accordance with this Agreement. Any new price applies only to purchases made after the new price is displayed, unless the User expressly agrees otherwise.
  • 3.1.4. Process message content, message metadata, technical logs and related information only to the extent reasonably necessary to provide and maintain the Services, troubleshoot technical issues, prevent fraud or abuse, protect the Services, process payments and comply with applicable legal obligations. Further information is provided in the Privacy Policy.
  • 3.1.5. Use Providers where reasonably necessary for delivery, hosting, network connectivity, payment processing, security or other supporting functions.
  • 3.1.6. Preserve, restrict access to or disclose information where required or permitted by applicable law or a valid decision, order or request from a competent authority.

3.2. The Operator shall:

  • 3.2.1. Use commercially reasonable efforts to make the Services available in accordance with the description shown on the Website and at the time of purchase.
  • 3.2.2. Where reasonably possible, investigate a reported technical defect affecting a paid Private Number and provide an appropriate remedy where the Service was not supplied as agreed.
  • 3.2.3. Process personal data in accordance with the Privacy Policy and applicable data protection law.
  • 3.2.4. Make available a reasonable channel through which Users may submit technical questions or complaints.

3.3. The User may:

  • 3.3.2. Contact the Operator regarding technical problems, billing issues or complaints using a communication channel made available on the Website or in the Operator Details section.
  • 3.3.3. Exercise any mandatory consumer, privacy or other statutory rights that apply to the User.

3.4. The User shall not:

  • 3.4.1. Use the Services for unlawful, fraudulent or abusive activity, including financial fraud, identity theft, phishing, impersonation, harassment, spam or other activity prohibited by applicable law.
  • 3.4.2. Use the Services to gain unauthorised access to an account, circumvent security controls or violate the terms or rights of a third-party service.
  • 3.4.3. Use scripts, automated tools or other methods in a manner that disrupts, overloads, probes, scrapes or interferes with the Website or Services without the Operator’s permission.
  • 3.4.4. Intentionally use Public Numbers to receive information that is confidential, sensitive or belongs to another person without an appropriate lawful basis or authorisation.
  • 3.4.5. Misrepresent the nature, origin or authorised use of a telephone number or the Services.

4. Provision and Availability of the Services

4.1. The Operator uses commercially reasonable efforts to make the Services available but does not guarantee uninterrupted or error-free operation. Telecommunications networks, hosting systems, payment providers and third-party platforms may experience outages, delays, filtering or other restrictions outside the Operator’s reasonable control.

4.2. Virtual and temporary numbers may be rejected, blocked or unsupported by particular websites, applications, banks, social networks or other third-party senders. The Operator does not guarantee that a particular third party will send or deliver an SMS to a Public Number or Private Number.

4.3. A failure by a third-party sender to support virtual, VoIP or temporary numbers does not by itself mean that the Service supplied by the Operator is defective, provided that the number and functionality purchased by the User were otherwise made available as described.

4.4. Where a paid Service itself is not supplied or is not in conformity with the description applicable at the time of purchase, the User retains any remedies that cannot lawfully be excluded, including any applicable consumer remedies.

4.5. Nothing in this Agreement excludes or limits statutory rights, remedies or liabilities that cannot lawfully be excluded or limited.

5. Rates and Payments

5.1. Paid Private Numbers and other paid Services are prepaid unless the Website expressly states otherwise.

5.2. The price and any applicable taxes or charges are displayed before the User completes the purchase. The User is responsible for reviewing the displayed price before placing the order.

5.3. The Operator may change Rates for future purchases. A price change does not retrospectively increase the price of a Service already purchased.

5.4. A Payment may be refused, reversed or delayed by a payment provider, bank or fraud-prevention system. The Operator is not required to activate a paid Service until the Payment has been successfully confirmed.

6. Suspension and Termination

6.1. The User may stop using the Services at any time. Termination does not affect obligations or liabilities that arose before termination.

6.2. A Private Number and its associated Private URL expire automatically at the end of the validity period displayed at the time of purchase, unless a different period is expressly stated.

6.3. The Operator may suspend, restrict or terminate a Service, with or without prior notice where reasonably necessary, if:

  • (a) there is an emergency, security incident, technical failure or threat to the Website, networks or Services;
  • (b) the Operator reasonably suspects fraud, unlawful conduct, abuse, unauthorised access or material breach of this Agreement;
  • (c) the Operator is required to act by applicable law or by a valid decision, order, request or notice from a competent authority;
  • (d) a Provider suspends or withdraws infrastructure, numbers, connectivity or another dependency necessary to provide the Service;
  • (e) the User uses automation or other methods that materially disrupt or overload the Website or Services; or
  • (f) a force majeure event prevents or materially impairs delivery of the Service.

6.4. Where a paid Service is terminated by the Operator for reasons not attributable to the User and the User has not received the paid functionality for the relevant period, the Operator will provide any remedy required by applicable law and may, where appropriate, provide a replacement, service credit, price reduction or refund.

7. Refunds, Withdrawal and Consumer Rights

7.1. Except where required by applicable law, a paid Service that has been correctly activated and made available as described is non-refundable merely because the User no longer wishes to use it.

7.2. Where the User is a consumer, mandatory statutory rights remain unaffected. Depending on the nature of the Service and the circumstances of the purchase, a consumer may have a statutory withdrawal period. Where required by law, the Website may ask the consumer to expressly request that performance begins during the withdrawal period and to acknowledge the legal consequences of immediate or completed performance.

7.3. If a consumer validly withdraws after expressly requesting that a service begin during an applicable withdrawal period, the consumer may be required to pay a proportionate amount for the service already supplied, but only to the extent permitted by applicable law.

7.4. If a paid Service is not supplied, or if the Service is not in conformity with what was agreed, the User may be entitled to an appropriate remedy under applicable law. Depending on the circumstances, this may include bringing the Service into conformity, a replacement, a proportionate reduction in price, termination or reimbursement.

7.5. No refund is due solely because a specific third-party platform, application or sender refuses or is unable to send an SMS to a virtual, VoIP or temporary number, provided that this limitation was disclosed and the Service itself was otherwise made available as described.

7.6. Nothing in this Section limits any right or remedy that cannot lawfully be waived or excluded.

8. Responsibility and Limitation of Liability

8.1. The User is responsible for the purpose for which the Services are used and for ensuring that such use complies with applicable law and with the rules of any third-party service accessed by the User.

8.2. To the maximum extent permitted by applicable law, the Operator is not liable for indirect, incidental, special or consequential loss arising from the use of, or inability to use, the Services, including loss resulting from third-party network failures, sender restrictions, platform policies or other circumstances outside the Operator’s reasonable control.

8.3. The Operator does not assume responsibility for unlawful, fraudulent or abusive acts committed by a User through the Services. The Operator may suspend access and cooperate with competent authorities where required or permitted by law.

8.4. To the extent permitted by applicable law, the User shall indemnify the Operator against reasonable losses, claims and costs arising directly from the User’s unlawful use of the Services or material breach of this Agreement.

8.5. Nothing in this Agreement excludes or limits liability for fraud, wilful misconduct, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded or limited.

9. Privacy and Data Processing

9.1. Personal data is processed in accordance with the Operator’s Privacy Policy and applicable data protection law.

9.2. Depending on the Service used, the Operator may process information such as account details, transaction identifiers, IP addresses, timestamps, technical logs, message metadata and message content where reasonably necessary for service delivery, security, fraud prevention, troubleshooting or compliance with legal obligations.

9.3. The Privacy Policy describes the categories of personal data processed, purposes and legal bases, recipients or categories of recipients, retention criteria, applicable international transfers and the rights available to individuals.

9.4. Public Numbers are intentionally public. Messages received through a Public Number may be visible to anyone and should not be treated as private or confidential.

10. Miscellaneous

10.1. Entire Agreement. This Agreement, together with the policies expressly incorporated into it, represents the agreement between the Parties regarding the Services.

10.2. Control of Numbers. Telephone numbers and technical resources made available through the Services remain subject to the control, allocation rules and technical availability of the Operator and relevant Providers. A User does not acquire ownership of a telephone number.

10.3. Changes to Services. The Operator may make reasonable technical, security or operational changes to the Services. Where a change materially and negatively affects an ongoing paid Service, any mandatory rights available to the User remain unaffected.

10.4. Severability. If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions continue in effect to the extent permitted by law.

10.5. Cooperation with Authorities. The Operator does not permit the Services to be used for illegal activity. The Operator may preserve and disclose information to competent law-enforcement, judicial or regulatory authorities where required or permitted by applicable law, including in response to valid preservation, production, investigation or mutual legal assistance procedures. The Operator may refrain from notifying the User where notification is prohibited by law or could prejudice an investigation or legal process.

10.6. Electronic Evidence. Where applicable, the Operator may receive and comply with valid orders and decisions concerning electronic evidence through the channels and procedures established by applicable national and European Union law.

10.7. Governing Law. This Agreement is governed by the laws of the Republic of Cyprus. If the User is a consumer, this choice of law does not deprive the User of mandatory protections that apply under the law that would otherwise be applicable to that consumer.

10.8. Complaints. A User may submit a complaint using a communication channel made available on the Website or through the address displayed in the Operator Details section. The Operator will review complaints within a reasonable period, taking into account their nature and complexity.
